Ellen B. Fishman, head of Martin Clearwater & Bell LLP’s Appellate Department, is a well known and respected appellate advocate. Ms. Fishman has handled hundreds of complex appeals at every level of the state and federal courts, including numerous cases of first impression. The Court of Appeals decisions Daniel J. v. New York City Health and Hospital Corp. and Allende v. New York City Health and Hospital Corp. are two seminal cases briefed and argued by Ms. Fishman.
Before joining MCB in 2003, Ms. Fishman served as Senior Counsel in the Appeals Division of the New York City Law Department. Her practice has included representation of all the facilities under the jurisdiction of the New York City Health and Hospitals Corporation, as well as the City’s Chief Medical Examiner and the Department of Health and Mental Hygiene. Ms. Fishman is a frequent lecturer on appellate practice, evidence and trial advocacy. She has been invited to make presentations for the New York State Bar Association, State Judicial Seminars, and New York City Corporation Counsel’s continuing legal education programs. In 2008, Ms. Fishman received the State Bar Association's first Judge Hugh Jones Award in recognition of her service to the Appellate Courts Committee. She is AV® rated by Martindale-Hubbell® which is their highest rating.
