The Labor and Employment Practice Group at Martin Clearwater & Bell LLP assists clients throughout New York State and beyond by providing practical advice and counseling to avoid potential litigation where possible, and to defend against lawsuits when necessary.


MCB’s Labor and Employment Practice Group primarily represents companies and executives in a wide range of issues arising in the context of employment relationships and partnerships. The Practice Group is led by Valerie K. Ferrier, an experienced litigator and trial lawyer. The attorneys of MCB provide experienced and knowledgeable representation. They advise, educate, and offer creative solutions to their clients to reduce the risk of litigation. MCB believes that alternative dispute resolution, including mediation, can be a cost-effective way to avoid to prolonged litigation. When litigation is unavoidable, however, the Practice Group will respond with an aggressive defense, whether the claim arises in federal or state court, an administrative agency, or arbitration. The Practice Group will always consult with clients about litigation strategy, and will keep them updated throughout the process so they never have to wonder about the status of their case.


Labor and Employment laws continue to multiply and evolve, and MCB’s attorneys communicate with clients to ensure that they are informed of the latest developments that affect them. The Firm offers advice and counseling regarding contracts, non-compete/non-solicitation agreements, handbooks, policies and procedures, and provides training to management and staff.  The lawyers of the Practice Group can also function as “external HR,” to help clients respond appropriately to ad hoc situations as they arise.


MCB’s Labor and Employment Practice Group defends clients against the full range of employment claims, including those related to interviewing/onboarding, hiring and promotion, discipline, firing, employee leave, whistleblowing, wrongful discharge, misclassification, discrimination and retaliation, and wage and hour disputes under the Fair Labor Standards Act and New York Labor Law. The Firm has experience with single plaintiff cases, as well as class and collective actions. In the event that a favorable outcome is not achieved, MCB’s attorneys are versed in appellate practice in both state and federal court.
