Michael C. Clarke is Of Counsel at Martin Clearwater & Bell LLP, where he defends doctors, teaching hospitals, health care systems and other medical professionals in medical malpractice litigation and other healthcare matters.  Mr. Clarke has thirty years of experience in the areas of health law; ethics; risk management and avoidance; corporate and government program compliance; patient and elder care; nursing home oversight; and, labor and construction.  Most recently, Mr. Clarke served as the Deputy Inspector General/Legal, Chief of Staff and Counsel, Director of Training, and Deputy Inspector General for Welfare for the New York State Inspector General’s Offices; Director of Compliance for Pratt & Whitney/United Technologies Corporation; Director of the Office of Special Investigations for the New York State Department of Labor; Special Assistant Attorney General for the New York State Attorney General’s Medicaid Fraud Control Unit; and as in-house counsel at Memorial Sloan-Kettering Cancer Center.  Mr. Clarke commenced his legal career as a prosecutor in New York City, then as a Senior Associate with Martin Clearwater & Bell.


As well as being an experienced litigator, Mr. Clarke has providing extensive in-service trainings in health care, skilled nursing and long-term care, hospital, corporate and government settings, particularly in the areas of risk management; legal, regulatory, international trade, ethics and labor compliance; and, the improvement of overall quality of care in the hospital and health-care institutional setting.  Mr. Clarke created and implemented a program wherein he gave hundreds of in-person in service presentations on care plan compliance to health care workers in nursing homes and long-term care facilities in New York State.  Nationally recognized, this program was listed on the National Center on Elder Abuse’s best practices listing. Mr. Clarke was also assigned by the New York State Inspector General as lead investigations counsel on matters arising out of the Mario M. Cuomo Bridge, a $4 billion design and build bridge construction project in New York State.  Along with investigating complaints and allegations of failure to comply with statutes and regulations by both corporations doing business with New York State and state agencies involved with the bridge project, Mr. Clarke delivered all fraud avoidance and ethics compliance trainings to all involved contractors, subcontractors and government partners.  


Mr. Clarke graduated from St. John’s University School of Law, and holds a Bachelor of Arts Degree in English from Fordham University.


Mr. Clarke is a member of the American Health Lawyers Association, New York State Bar Association, the New York City Bar Association, the Association for Healthcare Risk Management of New York, the New York Welfare Fraud Investigators’ Association, and the Long Island Labor Advisory Counsel.  Mr. Clarke is admitted to practice in the State Courts of New York and the United States District Courts for the Southern and Eastern Districts of New York.
