Discontinuance in Neurosurgery Case

Senior Trial Partner Laurie Ann Annunziato, Partner Michael Manning, and Associate Christopher Daniel obtained discontinuances of our client hospital and neurosurgeon prior to having to file a summary judgment motion on their behalf. The plaintiff presented to our client hospital to undergo a repair of the plaintiff’s semicircular canal dehiscence. The procedure was performed by our client neurosurgeon and the co-defendant ENT surgeon. Following the surgery, the plaintiff was admitted to our client hospital for monitoring by the neurosurgery team. After the plaintiff was discharged, the plaintiff developed hearing loss and had to undergo a revision surgery, which was again performed by the co-defendant ENT surgeon and our neurosurgeon. MCB was prepared to file a motion for summary judgment on behalf of our client hospital and neurosurgeon, supported by an expert affirmation from our neurosurgery expert, and ultimately convinced plaintiff to discontinue all claims against our hospital and neurosurgeon in lieu of filing a motion.
